Privacy Policy


This privacy policy explains how personal information is collected, used and disclosed by Byga, Inc. ("Byga"). For information about our Terms of Service ("Terms"), please visit https://byga.net/tos.

INFORMATION BYGA COLLECTS


  • Byga collects information primarily to provide better services to our clients. This includes information provided through the Byga registration or post registration process which can include name, email address, postal address, phone number, company name, and credit card/payment information.
  • Byga may also collect information such as the operating system running on your device, Internet Protocol (IP) address, access times, browser type, browser language settings, and the website visited prior to the Byga site. Byga may also collect information about how you use Byga service.
  • Byga automatically collects information using "cookies" and web beacons. Cookies are small data files stored on your hard drive by a website and web beacons are electronic images that may be used on Byga sites or emails. Among other things, cookies may help Byga improve the Byga site, the service, any marketing activities, and your experience. Cookies and web beacons are used to see which areas and features of our site or services are popular.
  • Most web browsers are set to accept cookies by default. If you prefer, you can choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features or services of our site and our application.
  • Third parties may collect personal information about your online activities over time and across sites when you visit the Byga site or use the Byga service.
  • Byga retains your data while you (a) are a customer of Byga, or (b) are using our service as part of a business client relationship. We retain the right to delete information after twelve (12) months of your or the associated business client relationship is terminated, or twenty fours (24) months of inactivity.


HOW BYGA USES THE INFORMATION COLLECTED


Byga uses the information collected primarily to provide, maintain, protect and improve Byga products and services, and to develop new products and services. Use of personal information collected through our sites or application is described in this Policy and/or on our sites. For example, Byga may use your information to:

  • Improve Byga services, sites and business operations;
  • Understand and enhance your experience using Byga sites, products and services;
  • Provide and deliver products and services you request;
  • Respond to your comments or questions;
  • Send you related information, including confirmations, invoices, technical notices, updates, security alerts, support notifications and administrative messages;
  • Communicate with you about promotions, upcoming events and news about products and services offered by Byga and our selected partners;
  • Link or combine it with other information Byga receives from third parties, to help understand your needs and provide you with better service; and
  • Protect, investigate and deter against fraudulent, unauthorized or illegal activity.


Byga may store and process personal information in the United States and other countries. By using our services you consent to this transfer of your personal information.


SHARING OF PERSONAL INFORMATION


Information You Share Outside of Byga

This privacy policy does not cover any third party services. To learn about those third parties' privacy practices, please visit their sites to understand their policies.


Information Byga Shares With Other Byga Users

  • Byga shares information primarily to enable use of Byga by Authorized Users with Byga’s clients on your behalf.
  • Byga shares your information only with clients your user account is associated with.
  • Byga is not responsible for client use of your information. You may need to work with the client to limit any information sharing or to remove or update any information submitted on your behalf. 
  • Team and scheduling information is available to Authorized Users of clients.
  • Depending on the client’s privacy settings, some player information such as team rosters is visible to other Authorized Users associated with the clients. This information may include full player name, birth year, and parent/guardian contact information.
  • Player date of birth, birth certificates and medical information may be made available to Authorized Users of clients based on roles and permissions, set or approved by the client via the Byga application.


Information Byga Shares With Third Parties

  • Byga does not share your personal information with third parties without your consent other than:
  • With third parties who work on Byga behalf provided such third parties enter into a written agreement with Byga requiring that the third party provide at least the same level of privacy protection as does Byga, is subject to the European Union Directive on Data Protection or another adequacy finding, or as a result of compliance with consumer privacy protection polcies such as compliance with the EU Safe Harbor or Swiss Safe Habor is deemed to provide adequeate privacy protection;
  • To comply with laws or to respond to lawful requests and legal process (provided that Byga will endeavor to notify you if Byga has received a lawful request for your information);
  • To protect the rights and property of Byga, our agents, customers and others including to enforce our agreements, policies and terms of use;
  • In an emergency, including to protect the personal safety of any person; and
  • For the purposes of a business deal (or negotiation of a business deal) involving sale or transfer of all or a part of our business or assets (business deals may include, for example, any merger, financing, acquisition, divestiture or bankruptcy transaction or proceeding).
  • Byga may also share aggregate or anonymized information derived from your personal information.

PERSONAL INFORMATION SECURITY


Byga takes reasonable steps to help protect your personal information in an effort to prevent loss, misuse, and unauthorized access, disclosure, alteration and destruction. It is your responsibility to protect your user names and passwords to help prevent anyone from accessing or abusing your accounts and services. You should not use or reuse the same passwords you use with other accounts as your password for our services.


MINORS


As noted in the Terms of Service, Byga does not permit use of our services by minors under the age of thirteen and minors thirteen and over require parental consent to use our services. When Byga’s clients include teams with minors under thirteen, the parents/guardians of the minor are responsible for entering and managing their minor’s information.


YOUR INFORMATION CHOICES AND CHANGES


You may opt out of receiving promotional emails from Byga by following the instructions in those emails. If you opt out, Byga may still send you non-promotional emails, such as emails about your Byga projects or our ongoing business relationship. You may also send requests about your contact preferences, changes and deletions to your information including requests to opt-out of sharing your personal information with third parties by emailing support@byga.net. Byga will respond within ninety (90) days to any request to delete your information. Individuals who have provided information to Byga's customers must send requests to change or delete such information to the particular Byga customer.


CHANGES TO THIS POLICY


Byga may change this Policy from time to time, and will update the effective date at that time. You agree that your continued use of Byga services after such changes have been published will constitute your acceptance of such revised Policy.


CONTACTING BYGA AND DISPUTE RESOLUTION


Byga provides periodic training for its employees involved in the collection and dissemination of user or client information. In addition, Byga's internal policies and procedures provide for disciplinary action if Byga employees fail to follow this Privacy Policy. We periodically self-assess and review these internal policies and procedures to review compliance.


Byga is committed to resolving complaints about your privacy and our collection or use of your personal information. Please direct any complaints or inquiries this privacy policy should first contact Byga at legal@byga.net.


In addition, the United States Federal Trade Commission is the statutory body that has jurisdiction to hear any claims against Byga regarding possible unfair or deceptive practices and violations of laws or regulations governing privacy.
