Byga Privacy Policy

This Privacy Policy (“Policy”) explains how Byga, Inc. (“Byga,” “we,” or “us”) collects, processes, and uses information that identifies or could reasonably be used to identify a person (“Personal Information”) in connection with this website and any other related websites, mobile applications, digital services and products or services that link to or provide this Policy, (collectively, the “Services”). 

This Policy applies to Personal Information we process for our own purposes as a data controller. We act as a   data controller for information we collect through a portion of the Services such as our corporate website, marketing, and customer support systems. It does not apply to:


  • Personal Information that we process on behalf of our business customers and organizations (“Byga Clients”), including in connection with our online youth sports platform and mobile application (the “Byga Platform”). We use Personal Information we receive from or on behalf of Byga Clients solely according to the Byga Client’s instructions and our agreements with that Byga Client; or
  • Personal Information collected by or on behalf of any third-party website, mobile application or device to or through which the Services may link or connect (the provider of such third party service, a “Third Party”).


For clarity, the Byga Client, not Byga, determines the purposes and means of processing Personal Information entered into or generated within the Byga Platform, including athlete information, parent/guardian information, team assignments, registration details, program participation information, communications, and documents (“Client Data”). If you have concerns regarding Personal Information that we process on behalf of a Byga Client, including any information concerning parents, guardians, or athletes, please direct your concerns to that Byga Client.

By using the Services, you agree to this Policy, which may be updated by us at any time. You should review this Policy carefully. If you do not agree with it, you may not use the Services. Please note that if you do not provide certain Personal Information to Byga when requested, we may not be able to provide you with access to all areas of the Services.


1. Information We Collect


1.1 Information Provided by You.


Personal information you may provide to us through the Services or otherwise includes: 


  • Contact data, such as your first and last name, salutation, email address, billing and mailing addresses, professional title and company name, and phone number;
  • Demographic data, such as your city, state, province, territory, country of residence, postal code, gender, and age; 
  • Profile data, such as the username and password that you may set to establish an online account in connection with the Services; 
  • Communications data based on our exchanges with you, including when you contact us through the Services or otherwise; 
  • Transactional data, such as information relating to or needed to complete your order on or through the Services; 
  • Marketing data, such as your preferences for receiving our marketing communications and details about your engagement with them; and
  • Other data not specifically listed here, which we will use as described in this Policy or as otherwise disclosed at the time of collection.


As noted earlier, Byga processes Personal Information contained within Client Data on behalf of Byga Clients, who determine the purposes and means of processing, and subject to Byga’s agreements with such Byga Clients. Examples include athlete information, team assignments, roster data, attendance, registration information, internal communications, documents, and program participation details. Such information is not controlled by Byga.


1.2 Automatic Data Collection


We, our service providers, and our business partners, including our app store providers, may automatically log information about you, your computer or mobile device, and your interaction over time with the Services, our communications and other online services, such as:


  • Device data, such as your computer or mobile device’s operating system type and version, app version, crash data, manufacturer and model, browser type, screen resolution, RAM and disk size, CPU usage, device type (e.g., phone, tablet), IP address, unique identifiers limited to those used for app functionality or diagnostics, language settings, mobile device carrier, radio/network information (e.g., Wi-Fi, LTE, 5G), and general location information such as city, state or geographic area.
  • Online activity and analytics data, such as pages or screens you viewed, how long you spent on a page or screen, the website you visited before browsing to the Services, navigation paths between pages or screens, information about your activity on a page or screen, access times and duration of access, and whether you have opened our emails or clicked links within them.
  • Geolocation data when you authorize our mobile application to access your device’s location.
  • Communication interaction data such as your interactions with our emails or other communications (e.g., whether you open and/or forward emails) – we may do this through use of pixel tags (which are also known as clear GIFs), which may be embedded invisibly in our marketing emails.

App-store operators may independently collect device or diagnostic data under their own privacy disclosures. Byga does not control such independent collection.


1.3 Cookies and Similar Technologies


Some of the automatic collection described above is facilitated by the following technologies:


  • Cookies, which are small text files that websites store on user devices and that allow web servers to record users’ web browsing activities and remember their submissions, preferences, and login status as they navigate a site. Cookies used on our sites include both “session cookies” that are deleted when a session ends, “persistent cookies” that remain longer, “first party” cookies that we place and “third party” cookies that our third-party business partners and service providers place.
  • Local storage technologies, like HTML5, that provide cookie-equivalent functionality but can store larger amounts of data on your device outside of your browser in connection with specific applications.
  • Web beacons, also known as pixel tags or clear GIFs, which are used to demonstrate that a webpage or email was accessed or opened, or that certain content was viewed or clicked. These may come in the form of small transparent graphic images that are automatically loaded onto your browser/device when you visit a website or open an html format email message.


1. 4 Payment Information


A third-party vendor may collect payment information from you on our behalf. We currently utilize the services of third-party vendors, including Maple, Inc., Intuit, Inc. (Quickbooks Online), Stripe, Inc. and Plaid Inc., to collect and process your credit/debit card and/or bank transfer information and we may gain access to certain limited payment information, including your method of payment, billing address, the last four digits of your account number and card expiration date. The processing of your credit card information by third-party vendors is subject to the terms and privacy policies of those vendors. For example, invoicing by Maple, Inc. is subject to Maple’s terms and the Maple Privacy Policy, invoicing by Quickbooks Online is subject to Intuit’s terms and the Intuit Privacy Policy, payment processing by Stripe, Inc. is subject to Stripe’s terms and the Stripe Privacy Policy; the processing of bank transfers / ACH payments is facilitated by Plaid, Inc. and is subject to Plaid’s terms and the Plaid End User Privacy Policy


1.5 Third-Party Information 


We may receive Personal Information about you from third-party sources, including publicly available sources, such as government agencies, public records, and social media platforms, and may combine such Personal Information with Personal Information we receive from you. We do not receive athlete, parent/guardian, or team-related Personal Information from external sources except as necessary to provide services to, or where instructed to do so by, a Byga Client.


2. How We Use Information


Your Personal Information may be collected, stored, disclosed and processed by Byga for the following purposes or as otherwise described in this Policy or described at the time of collection:


Service delivery and operations. We may use your Personal Information to:


  • generally provide, operate and improve the Services and our business;
  • personalize the Services, including remembering the devices from which you have previously logged in and remembering your selections and preferences as you navigate the Services;
  • establish and maintain your user profile on the Services;
  • enable security features of the Services, such as by sending you security codes, and remembering devices from which you have previously logged in;
  • communicate with you about the Services, including by sending Services-related announcements, updates, security alerts, and support and administrative messages;
  • communicate with you about events or contests in which you participate;
  • understand your needs and interests, and personalize your experience with the Services and our communications; and
  • provide support for the Services, and respond to your requests, questions and feedback.


Where Personal Information constitutes Client Data, we use such information solely to provide the Services on behalf of the relevant Byga Client, and as permitted by our agreements with the Byga Client.


Research and development. We may use your Personal Information for research and development purposes, including to analyze and improve the Services and our business and to develop new products and services.


Marketing and advertising. We, our service providers, including artificial intelligence service providers, and our third-party advertising partners may collect and use your Personal Information for marketing and advertising purposes:


  • Direct marketing. To send you direct marketing communications and may personalize these messages based on your needs and interests. You may opt-out of our marketing communications as described in “Opt-out of communications” in section 9 below.
  • Interest-based advertising. We may use cookies and other tracking technologies on our public-facing corporate website (not the Byga Platform) to help deliver Byga advertisements on third-party platforms such as Google or Facebook. Note that we do not use Personal Information collected through the Byga Platform for interest-based or cross-site advertising, and we do not share Client Data with third-party advertising partners for such purposes. Clients may independently incorporate tracking technologies (such as Google or Facebook pixels) on the public-facing websites or pages they control. Such tracking is implemented and controlled by the Client and is governed by the Client’s own privacy notices and practices. 


Service improvement and analytics. We may use your Personal Information to analyze your usage of the Services, improve the Services, improve the rest of our business, help us understand user activity on the Services, including which pages are most and least visited and how visitors move around the Services, as well as user interactions with our emails, and to develop new products and services.


Compliance, security and protection. We may use your Personal Information to:

  • comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas, investigations or requests from government authorities;
  • protect our, your or others’ rights, privacy, safety or property (including by making and defending legal claims);
  • audit our internal processes for compliance with legal and contractual requirements or our internal policies;
  • enforce the terms and conditions that govern the Services; and
  • prevent, identify, investigate and deter fraudulent, harmful, unauthorized, unethical or illegal activity, including cyberattacks and identity theft.


With your consent. We may use Personal Information in any other ways to which you have consented or provided permission.


To create aggregated, de-identified and/or anonymized data. We may create aggregated, de-identified and/or anonymized data from your Personal Information and other individuals whose Personal Information we collect. We make Personal Information into de-identified and/or anonymized data by removing information that makes the data identifiable to you. We may use this aggregated, de-identified and/or anonymized data and share it with third parties for our lawful business purposes, including to analyze and improve the Services, such as to train our AI models and for other machine learning purposes, and to otherwise promote our business. To the extent we create such data, we will not attempt to re-identify any such de-identified or aggregated data.


Cookies and similar technologies. In addition to the other uses included in this section, we may use cookies and similar technologies described above for the following purposes:


  • Technical operation. To allow the technical operation of the Services, such as by remembering your selections and preferences as you navigate the site, and whether you are logged in when you visit password protected areas of the Services.
  • Functionality. To enhance the performance and functionality of our Services.
  • Advertising. Cookies on our public-facing corporate website (not the Byga Platform) may be used to help deliver Byga advertisements on third-party platforms such as Google or Facebook. We do not use cookies or similar technologies within the Byga Platform for interest-based or cross-site advertising.
  • Analytics. To help us understand user activity on the Services, including which pages are most and least visited and how visitors move around the Services, as well as user interactions with our emails.


3. Sharing of information


We may share your Personal Information with the following parties and as otherwise described in this Policy, in other applicable notices, or at the time of collection.


  • Affiliates. Our corporate parent, subsidiaries, and affiliates.
  • Service providers. Third parties that provide services on our behalf or help us operate the Services or our business (such as hosting, information technology, customer support, artificial intelligence and machine learning, online chat functionality providers, email delivery, marketing, consumer research and website analytics).
  • Invoicing and Payment processors. Byga Client invoicing is provided by Maple, Inc. is subject to Maple’s terms and Maple Privacy Policy.  Any payment card information you use to make a purchase on the Services is collected and processed directly by our payment processors, including Stripe, Inc. and Plaid Inc. These payment processors may process your Personal Information in accordance with their own privacy policies and terms. For example, the processing of your credit card information by Stripe, Inc. is subject to Stripe’s terms and the Stripe Privacy Policy; the processing of your credit card information by Plaid, Inc. is subject to Plaid’s terms and the Plaid End User Privacy Policy
  • Advertising partners.  Byga does not allow third-party advertising partners to collect information from the Byga Platform for interest-based or cross-site advertising. Cookies and tracking technologies on the corporate website may be used to help deliver Byga advertisements on third-party platforms (e.g., Google or Facebook).
  • Third parties designated by you or your organization. We may share your Personal Information with third parties when you, or your organization as a Byga Client, direct or authorize us to do so, for example, when connecting our platform with another service. In cases where we process data on behalf of a Byga Client, we share Authorized User information only in accordance with the Byga Client’s instructions and in line with our processing obligations. 
  • Business and marketing partners. Third parties with whom we co-sponsor events or promotions, with whom we jointly offer products or services, who help facilitate purchases of our products or services, or whose products or services may be of interest to you. For clarity, we do not share Client Data with business or marketing partners unless expressly directed by a Byga Client.
  • Professional advisors. Professional advisors, such as lawyers, auditors, bankers and insurers, where necessary in the course of the professional services that they render to us.
  • Authorities and others. Law enforcement, government authorities, and private parties, as we believe in good faith to be necessary or appropriate for the compliance and protection purposes described above.
  • Other users. You may choose to make your Personal Information available to other users of the Services, such as by posting in public fora.
  • Business transferees. We may disclose personal information in the context of actual or prospective business transactions (e.g., investments in Byga, financing of Byga, public stock offerings, or the sale, transfer or merger of all or part of our business, assets or shares), for example, we may need to share certain personal information with prospective counterparties and their advisers. We may also disclose your personal information to an acquirer, successor, or assignee of Byga as part of any merger, acquisition, sale of assets, or similar transaction, and/or in the event of an insolvency, bankruptcy, or receivership in which personal information is transferred to one or more third parties as one of our business assets.
  • With your consent. We may share your Personal Information with other third parties with your consent or permission.


Note, sharing of your Personal Information that is controlled by Byga Clients with other users or other third parties is governed by your agreements with those Byga Clients or those third parties.


4. Retention


We generally retain Personal Information to fulfill the purposes for which we collected it, including for the purposes of satisfying any legal, accounting, or reporting requirements, to establish or defend legal claims, or for fraud prevention purposes. To determine the appropriate retention period for Personal Information, we may consider factors such as the amount, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorized use or disclosure of your Personal Information, the purposes for which we process your Personal Information and whether we can achieve those purposes through other means, and the applicable legal requirements. Retention periods for Client Data may also be determined by the applicable Byga Client.


When we no longer require the Personal Information, we have collected about you, we may either delete it, anonymize it, or isolate it from further processing.


5. International Processing


The Services are designed and intended for use in the United States. Personal information may be stored and processed in the United States and other countries. If you choose to access the Services from outside the United States, you acknowledge that you will be transferring your information, including Personal Information, outside of those regions to the United States for storage and processing, as necessary to provide the Services, and you consent to such transfer, storage, and processing. 


6. Other Sites and Services


While the Services may contain links or otherwise connect to websites, mobile applications, and other online services operated by third parties, this Policy does not cover such services or features. You access and interact with third-party websites, mobile applications, and online services at your own risk. We do not control and are not responsible for the content or practices of any third-party website, application or other product or service. Please review the appropriate third party’s terms and privacy policy to better understand its practices.


7. Security


We maintain physical, technical and administrative safeguards designed to protect the integrity and security of your information. We cannot, however, ensure or warrant the security of any information you transmit to us through the Services and you do so at your own risk. We also cannot guarantee that such information may not be accessed, disclosed, altered or destroyed by breach of any of our physical, technical or administrative safeguards. No security measures are perfect or impenetrable. We cannot control the actions of other users or other third parties with whom you may choose to share your information. Therefore, we cannot and do not guarantee that information you provide through the Services will not be viewed by unauthorized persons. We are not responsible for circumvention by any third party of any privacy settings or security measures contained within the Services.


8. Minors


The Services are not intended for use by children under 13 years of age. If you are a parent or legal guardian of a child from whom you believe we have collected Personal Information in a manner prohibited by law, please contact us using the contact information provided below. If we learn that we have collected Personal Information through the Services from a child without the consent of the child’s parent or guardian as required by law, we will comply with applicable legal requirements to delete the information. If your child, age 13 to 17, is accessing the Services without your consent as parent or guardian, please contact the Byga Client with which you are associated if you want your child’s account to be discontinued and data deleted. Collection of Personal Information relating to minors within the Byga Platform is performed solely on behalf of Byga Clients, and concerns regarding such data should be directed to the applicable Byga Client.


9. Your Information Choices and Changes


Access or update your information. If you have an account with us through the Services, you may review and update certain account information by logging into the account.


Opt-out of communications. You may opt-out of marketing-related emails by following the opt-out or unsubscribe instructions at the bottom of the email, or by emailing us at privacy@byga.net. Please note that if you choose to opt-out of marketing-related emails, you may continue to receive service-related and other non-marketing emails. To the extent your information is processed within the Byga Platform on behalf of a Byga Client, requests to opt out of Byga Client-operated communications should be directed to that Byga Client.


Cookies and other tracking technologies.  Byga uses cookies and other tracking technologies on our corporate website (https://www.byga.net) for functionality, analytics, and performance. Cookies and other technologies within the Byga Platform are limited to strictly necessary and functional purposes and are not used for interest-based or cross-site advertising. You can accept all cookies/tracking technologies, decline non-essential ones, or adjust your settings anytime in the site’s cookie preferences manager. Most browsers also let you remove or reject cookies. To do this, follow the instructions in your browser settings. Many browsers accept cookies by default until you change your settings. Please note that if you set your browser to disable cookies, the Services may not work properly. For more information about cookies, including how to see what cookies have been set on your browser and how to manage and delete them, visit www.allaboutcookies.org. You can also configure your device to prevent images from loading to prevent web beacons from functioning.


Blocking images/clear gifs: Most browsers and devices allow you to configure your device to prevent images from loading. To do this, follow the instructions in your particular browser or device settings. Note that this will generally prevent all images from loading, not just clear gifs.


Mobile location data. You can enable/disable our access to your device’s precise geolocation in your mobile device settings.


Advertising choices.  You can accept all cookies/tracking technologies, decline non-essential ones, or adjust your settings anytime in our corporate website’s cookie preferences manager. You may be able to limit use of your information for interest-based advertising through the following options:


  • Browser settings. Changing your internet web browser settings to block third-party cookies. 
  • Privacy browsers/plug-ins. Using privacy browsers and/or ad-blocking browser plug-ins that let you block tracking technologies.
  • Platform settings. Google and Facebook offer opt-out features that let you opt-out of use of your information for interest-based advertising on or through those platforms. You may be able to exercise that option at the following websites:

  • Ad industry tools. Opting out of interest-based ads from companies that participate in the following industry opt-out programs:

  • AppChoices mobile app, available at https://www.youradchoices.com/appchoices, which will allow you to opt-out of interest-based ads in mobile apps served by participating members of the Digital Advertising Alliance.
  • Mobile settings. Using your mobile device settings to limit use of the advertising ID associated with your mobile device for interest-based advertising purposes.


You will need to apply these opt-out settings on each device and browser from which you wish to limit the use of your information for interest-based advertising purposes. 


We cannot offer any assurances as to whether the companies we work with participate in the opt-out programs described above.


Do Not Track
. Some Internet browsers may be configured to send “Do Not Track” signals to the online services that you visit. We currently do not respond to “Do Not Track” signals. To find out more about “Do Not Track,” please visit http://www.allaboutdnt.com.


Declining to provide information. We need to collect Personal Information to provide certain Services. If you do not provide the information we identify as required or mandatory, we may not be able to provide those services.


Delete your content or close your account. You can choose to delete certain content through your account. If you wish to request to close your account, please contact us.


Shine the Light Notice

California residents may request and obtain from us, once a year and free of charge, information about categories of Personal Information (if any) we disclosed to third parties for those third parties’ own direct marketing purposes and the names and addresses of all third parties with which we shared Personal Information in the immediately preceding calendar year.

10. Changes to This Policy


We reserve the right to make changes to this Policy at any time. We will notify you about significant changes in the way we treat your information, such as by placing a prominent notice on our website or by sending you an email so that you can choose whether to continue using the Services. Any modifications to this Policy will be effective upon our posting the modified version (or as otherwise indicated at the time of posting). In all cases, your use of the Services after the effective date of any modified Policy indicates your acknowledgement that the modified Policy applies to your interactions with the Services and our business. Please revisit this page periodically to stay aware of any changes to this Policy. For the avoidance of doubt, disputes arising hereunder will be resolved in accordance with the Policy in effect at the time the dispute arose.
